Terms and Conditions
1. General
3d-mm.com is the online shop of "3D Media Mind", August-Bebel-Str. 26-53, D-14482 Potsdam, a project of My Domicile GmbH; commercial registerd under HRB 22003 P, Germany; represented by the director Ingolf Jung.
2. Contract Accomplishment
The picturs of the products in the online shop are legally noncomittal, but is a non-binding online catalog. By clicking on the order-button, you send a binding order of the articles which are in your shopping cart. You are contracting the element 5 onlineshop only. For further information please see theyr general terms and conditions. The confirmation of the order incoming immediately follows the order. As soon as your payment gets on our account, the products will be shipped.
The purchase contract is accomplished with the shipment confirmation or the delivery of the products (set up CD-Rom). The products are limited by time with an annual subscription with automatic renewal each 12 months. The text of the contract is not saved.
3. Delivery and payment
Payment possibilities are only acepted when shown during the order process. All prices are net prices, not showing local VAT. We reserve us the right to delivery a part of the order, if this seems to be an advantage. Special sending requests of our customers have to be paid by the customer. Shipping of the CD Rom is done to the price which is listed. For downloads additional costs can occur.For invoices off the internet, payment period is up to 4 weeks, except other payment conditions are fixed in a written form. An assertion for a higher damage caused by delay stays reserved.
4. Delivery times
Products which are on stock are shipped as quick as possible. If a delivery- or a service term is not respected due to force majeure, collective action, unpredictable obstacles or other conditions that can not be represented by us, the term is extended adequatly. When delivery terms are not respected due to other reasons then those described above, the customer has the right to fix a new term in written form and to menace a refusal and to withdraw from the delivery or service described in the contract. If the impossibility of delivery is due to disabilities of the manufacturer or one of our suppliers, both we and the customer can withdraw from the contract, if the delivery term is transgressed for more then 2 months. Claim for damages for arrears or impossibility, respectively non-performance, also those which happened until the withdraw of the contract are excluded, except if a legal agent has acted in a negligent manner.
5. Disclaimer Instruction
An online purchase can be withdrawed 14 days after reception of the products. It is sufficient to send the written withdrawel and a written declaration that the installed software was deinstalled and is not used, and that all safe copies have been made unusable, in time. Until a volume of 40 Euro, the customer has to pay the costs for the return.
We want to advise sou that following §312 d Absatz 4 BGB electronically delivered products are exempted from this withdraw right.
6. Warrantee
3D Media Mind guarantess that all sold products are free of material and fabrication erors and includes the guaranteed properties at the moment of the transfer of risk. By their arrival, the customer has to immediately control the products for defects and consistence. In the case of visible or hidden defects, the customer has to report them in a written form to us at least 10 days after reception of the products.
Otherwise the guarantee for these defects expires. The guarantee is 24 months after shipping. In case of reclamations, a purchase date with an invoice has to be proved. The guarantee expires if the customer alters the products. The 3D Media Mind GmbH has the right to freely repair the products. A partly or entire exchange of the product is acceptable. If defects are not corrected in an adequate period of time, the customer has the right to claim a annulment or a reduction. We refer to § 476a BGB.
7. Retention of title
Until the complete payment, the products stays the property of 3D Media Mind.
8. Saving and handling of person-related data
3D Media Mind guarantees to respect the private sphere of of persons, who are customers in our shop and to handle the personal data in a confidential way. The legal appointments are the German Data Protection Act (BDSG) and the information- and communication service law (IuKDG). The data received from you is saved. You always can let delete your data, please contact us under dialog@3d-mm.com.
9. Adress for service
The place of fulfilment and the adress for service is the domicile of 3D Media Mind. The only applied law is the law of Gemany. General conditions Germany.
